PRIVACY POLICY – Synevos

This Privacy Policy describes how Synevos, Inc. ("Synevos," "we," "us," or "our") collects, uses, and discloses information about you when you use our mobile application ("App"). By using the App, you agree to the practices described in this policy.
IMPORTANT: This App is for users 18 and older only. We do not knowingly collect information from anyone under 18.

1. INFORMATION WE COLLECT

1.1 Information You Provide Directly
Account Information: When you create an account, we collect your name, email address, and password.
Profile Information: You may choose to provide additional information such as age range, height, weight, and health conditions (e.g., high blood pressure, diabetes, anxiety, depression, thyroid condition, asthma). This information is completely optional. You can use core features of the App without sharing health information.
Payment Information: When you purchase a subscription, payment processing is handled by third-party processors (e.g., Apple App Store, Google Play Store). We do not store full credit card numbers.
Communications: If you contact us, we collect the information you provide in your communications.
1.2 Information Collected Automatically
Usage Data: We collect information about how you use the App, including features accessed, time spent, and interactions.
Device Information: We collect device type, operating system, unique device identifiers, IP address, and mobile network information. IP address may be considered precise location information if it identifies your location within 1,750-1,850 feet under certain state laws.
Cookies and Similar Technologies: We may use cookies and similar tracking technologies to collect usage data and store preferences.

2. HOW WE USE YOUR INFORMATION

We use the information we collect to:
  • Provide and maintain the App: Including to personalize content and send safety alerts based on information you provide
  • Process subscriptions: Manage billing, send renewal notices, and handle cancellations
  • Improve our services: Analyze usage patterns to enhance features and user experience
  • Communicate with you: Send administrative messages, updates, security alerts, and support responses
  • Respond to your requests: Address customer service inquiries and feedback
  • Comply with legal obligations: Enforce our Terms and protect our rights
We do not sell your personal information to third parties for marketing purposes. If we ever propose to sell information, we will obtain your separate, explicit consent as required by Washington law.

3. HEALTH INFORMATION – YOUR RIGHTS AND OUR COMMITMENTS

3.1 Optional and Voluntary
Any health information you provide (such as health conditions) is strictly optional. You can use the App without providing this information.
3.2 How We Use Health Information
We use health information only to:
  • Personalize educational content
  • Provide relevant safety alerts
  • Improve our wellness features
3.3 We Do Not Sell Health Information
We will never sell your health information to third parties for marketing or advertising purposes. Under Washington law, any sale of consumer health data requires a separate, valid authorization that must: be written in plain language, specify the exact data being sold and to whom, include an expiration date (maximum one year), be signed by you separately from any other consent, and not be a condition of providing the App's services. We do not engage in such sales.
3.4 Your Control
You can view, modify, or delete your health information at any time through your account settings. If you delete this information, we will no longer use it for personalization.

4. STATE-SPECIFIC PRIVACY RIGHTS

Depending on your state of residence, you may have additional privacy rights. This section describes those rights and how to exercise them.
4.1 VIRGINIA RESIDENTS (Effective July 1, 2025)
What is protected: "Reproductive or sexual health information" includes:
  • Pregnancy, menstruation, ovulation, or conception data
  • Contraceptive use or purchase
  • Location data that could indicate attempts to acquire reproductive health services
  • Any information derived or extrapolated from non-health data about the above
Your rights: We must obtain your explicit consent BEFORE collecting any reproductive or sexual health information. You may withdraw consent at any time through account settings. Violations of these rights may give you a private right of action with statutory damages of at least $500.
Our commitment: If you are a Virginia resident, we will not collect any information that could be considered reproductive or sexual health information without first obtaining your clear, affirmative consent through a separate consent flow.
4.2 WASHINGTON RESIDENTS
What is protected: "Consumer health data" includes:
  • Individual health conditions, treatment, diseases, or diagnosis
  • Health-related surgeries or procedures
  • Use or purchase of medication
  • Biometric and genetic data
  • Gender-affirming care information
  • Reproductive or sexual health information
  • Precise location information that could indicate attempts to acquire health services
Your rights: Separate consent for collection versus sharing of your health data, right to request deletion of your health data. We do not and will not use geofencing technology around health care facilities.
Our commitment: Collection consent will specify the categories of data, purpose, and categories of entities with whom data may be shared. You can withdraw consent at any time.
4.3 COLORADO RESIDENTS
Valid consent requirements for any processing of sensitive data (including health conditions) must meet all of the following elements:
  • Obtained through your clear, affirmative action (not silence, inactivity, or pre-ticked boxes)
  • Freely given (not conditioned on providing the service)
  • Specific (you can consent separately to different purposes)
  • Informed (you know exactly what you're consenting to)
  • Reflect your unambiguous agreement
No dark patterns: Consent cannot be obtained through "dark patterns"—user interfaces designed to manipulate your choices.
Our commitment: We will present consent requests clearly and separately from other terms. You will have granular control to consent to different uses separately. You may refuse consent without detriment to your ability to use core App features. You can withdraw consent easily at any time.
4.4 CALIFORNIA RESIDENTS
Protections for sensitive services: Information related to abortion, contraception, and gender-affirming care receives special protection.
What we do:
  • Segregation: We segregate any information related to reproductive health, contraception, and gender-affirming care from other data
  • No out-of-state disclosure: We will not disclose such information in response to out-of-state subpoenas, requests, or legal demands based on laws that interfere with reproductive rights
  • Law enforcement requests: We will not provide medical information to law enforcement without a valid warrant or your prior authorization, as required by California law
Your rights: You have the right to access, delete, and restrict use of your medical information. You have the right to know if your information has been disclosed.

5. HOW TO EXERCISE YOUR STATE RIGHTS

To exercise any of the rights described in Section 4:
  • Through the App: Go to Account Settings → Privacy → State Privacy Rights
  • By Email: Send your request to privacy@synevos.com
Verification: We may need to verify your identity and state residency before processing your request. We will respond within the timeframes required by applicable law (typically 30-45 days).
No Discrimination: We will not discriminate against you for exercising your privacy rights.

6. DATA SECURITY

We implement reasonable technical and organizational measures to protect your information, including:
  • Encryption of data in transit (using TLS/SSL)
  • Encryption of sensitive data at rest
  • Access controls limiting internal access to personal information
  • Regular security assessments
  • For California residents: Segregation of reproductive health data as required by AB 352
However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.
If you have reason to believe your interaction with us is no longer secure, please contact us immediately.

7. DATA RETENTION

We retain your information for as long as your account is active or as needed to provide you services. We may also retain and use your information to comply with legal obligations, resolve disputes, and enforce our agreements.
If you delete your account, we will delete your personal information within 30 days, except where we are required to retain it for legal reasons.
Under Washington law, if we ever obtain a valid authorization to sell data (which we do not), we must retain that authorization for six years.

8. YOUR RIGHTS AND CHOICES (GENERAL)

8.1 Account Information
You can access and update your account information at any time through the App settings.
8.2 Deleting Health Information
You can delete specific health information or your entire account through settings.
8.3 Communication Preferences
You can opt out of promotional emails by following the unsubscribe instructions in those emails. We may still send you non-promotional messages related to your account or subscriptions.
8.4 Do Not Track
The App does not currently respond to "Do Not Track" signals.

9. CHILDREN'S PRIVACY

The App is not intended for users under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we become aware that a user under 18 has provided us with personal information, we will take steps to delete such information and terminate the account.
If you are a parent or guardian and believe your child has provided us with information, please contact us immediately.

10. INTERNATIONAL USERS

The App is hosted and operated in the United States. If you access the App from outside the U.S., you consent to the transfer of your information to the U.S., which may have different data protection rules than your country.

11. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the updated policy.
The "Effective Date" at the top of this page indicates when this policy was last revised.

12. THIRD-PARTY LINKS AND SERVICES

The App may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to read their privacy policies.
